Minimum Sentence For 3rd Degree Murder Of Victim Under 13

HARRISBURG – PA Senate President Pro Tempore Joe Scarnati says he plans to introduce legislation that would impose a mandatory minimum sentence of 13 years in prison for an individual convicted of third degree murder when the victim is a child under age 13. The lawmaker said the legislation has become a necessity in light of the recent lenient sentence handed down by Philadelphia Judge Benjamin Lerner to an individual convicted of murdering multiple newborn babies at Dr. Kermit Gosnell’s abortion clinic. The judge sentenced the employee to only 6-12 years in prison. There is no mandatory minimum sentence for someone convicted of a third degree murder of a child.
